Well there's no way he can force you without a contract in place, which I'm guessing there isn't. Though he will more than likely feel let down and you'd be likely not to get recommendations.

I'd leave the bg as is, and in your header I'd usally float the logo left and nav right depending on the designer

So what you've started with is, an external css file which states that the background image is well, the image we're see'ing. Now if your a beginner that's a great start. Your next step is to add a div containting your header image and possibly your containg nav, if you find it possible. let us know, I'll help out
