I am not sure if this is the correct place to put this topic. If it is, I apologise.

 

The question I have is regarding an image. I have found an image of a flag used by a city council that I would like to use as the base for a logo. I was wondering if I would be able to use this image freely as it is in the public domain or would I have to ask permission from the council.

 

If anyone can answer, I would be grateful.

Does the flag design belong to the city council (is it 'their' flag)? If so then you will need permission.

It would be advisable to seek permission of the council before using the flag in any way. Although it might be 'public domain' you must not use it in any way that could be construed as the council in question endorsing or giving approval to the web site or its content.

If it's a coat of arms on the flag then it is granted to the town/city by the Royal Coat of Arms and usually very heavily protected against commercial use without permission from the council (and payment).

 

I only know because our local council forgot to renew theirs and it made the local news when they realised and renewed it. Having renewed it, they stopped people using it without permission.
