  1. This is very true - make sure you have a good contract. With regard to small claims court, don't make the mistake in thinking that you can sue there if the defendant is NOT within that county, e.g. you got the job via a post on the Internet and the other person lives in another part of town or another state. Unfortunately the jurisdiction of the court usually only extends to that county. Pressuring or reminding a client often is typically not harrassment and many debtors think that there is some right they have. Going overboard might be, e.g. you call his house every 4 hours. Best is to try to work with the client and see whether it's a matter of trying to work out the situation with a different personality. At some point you'll know whether or not the client ever really will pay and perhaps setting a time when things are to happen is a good way to handle the situation. Best is to get some money up front to limit losses and provide leverage later in recouping the money.
  2. Get a friend who is a lawyer to write the letter on good paper. That might do the trick. If you really want to get creative you can write to the offender's host and make the claim that his link is in violation of their terms of service (read through the fine print and you should find something.)
  3. It's a great link but also be aware of the fact that trademarks come in different "classes." This means that you can have the same mark as someone else but for a different type of area/industry, e.g. abomino shoes can coexist with abomino internet services. I've dealt with many of these and frequently it's some big company overstepping its boundaries and trying to scoop up domain names on the cheap with intimidation tactics. In one instance there was actually some justification and a pretty interesting case actually. Related industries even though of different classes but it dealt with a unique and fanciful name, like "abomino."
