host company refuses refund even though they have 90 day money back garuntee

so a month ago i signed up with www.host1plus.com for a cloud server
from the very first day iv been having problems with the server and have not been at all happy with the service and quality of support.
30 days later i signed up with another host, and moved my files, since host1plus offers a 90 day money back guarantee i requested a refund. they kept sending me emails back and forth for over 10 days trying to change my mind about the refund, they kept saying 'what if we did this?' 'what if we did that?' 'what if we offered to install ur site for u and optimize it so it doesnt run so slow?" it got to the point where in every email i had to stress that if they didnt stop trying to convince me and just offer me my refund i would take legal action. then i didnt hear from them for like 3 days so i rang them, (i think they are actually based in greece or cyprus).. this was on sunday, they picked up and i said hi iv requested a refund and i havent heard form anyone so i want to see whats going on, immediately he said 'are your mr blah blah'.. he knew my name as if im the only customer they have!!! anyway he said to me someone will do the refund on monday, its now Wednesday and i just received an email saying:
We haven't received cancellation request from you. Your service is not cancelled and we don't see the reason to issue your refund. Please contact us if you will have any questions.
What can i do? its only £40 but its not about the money, theyv really pissed me off with this attitude, and its the principle you know..

Hope you get it sorted, or worst case scenario you'll just have to learn from it.

Like everything in this day and age, the small print will highlight their standpoint on the issue and I would suggest you read the terms that you would have agreed to both using/viewing their site and when purchasing.
It is a shame none the less however that somone has yet again been caught by one of these such offers, although I will add having looked at their terms of service (and its layout) it is setout to be difficult... which should be a sign to further avoid such hosts in the future.

Thank you for your reply, today I received an email from them after contacting them last night fuming and unloading everything that came out of my mouth. It stated in the email that i wasnt eligible for a refund since i paid with paypal!!
Oh well, i guess its a lesson learnt, and ill be sure to write a review of their company on every public forum i can find out there

It is only £40 so maybe it's best just to wash your hands of the issue and walk away. Sometimes it just isn't worth the effort.

Sounds like they must be a pretty small host if they knew your name when you phoned. The about us page claims that they have 4 offices throughout Europe which from the sounds of your experience is a lie or at least an exaggeration on the truth!
They will of probably disappeared in a month... never to be seen again. I hope you manage to get it sorted.
