If I delete a theme (only the theme), and then upload it at a laster date (a backed up copy) will it work fine?

I have a client who has broken a payment contract. I have put their site in maintenance mode, but I would like to remove the theme I heavily customizes as well in case they figure out how to access the Wordpress install. If payment comes through, I'd like to be able to quickly restore it though. SO basically I just want to get the files of the server temporarily.

I'd like to do the same with the 'uploads' folder as well because that is where most of the graphics I worked on are stored.

Can I just delete both temporarily, and upload them later?

Thanks a lot.

Yup, that part is simple enough.

Accessing their hosting, on the other hand, might be badly construed, legally speaking. If they're in breach of contract, take them to court.

If I take them to small claims court in Canada, I still have to pursue them for payment or get a collections agency to. I have no confidence whatsoever from my dealings so far that it will make any difference. They have the resources to keep going to court and drawing this out. I don't.

I learned a valuable lesson in not putting a site live until after final payment clears. So I will cut my losses, and leave it at that.

So, they will either be not using my work for free anymore, or they will decide to pay to get the site back up. The terms of the contract give me site ownership until final payment, and the right to take the site down for non-payment. It also gives full authorization to access the server. So I am going to use those options.

The only thing the contract didn't cover (has been revised) is that final payment had to clear BEFORE the site went live. I normally took 1/3 down, 1/3 on approval, 1/3 when job was done. Had no issues for years.

Thanks!

Fair enough then, looks like you've got everything covered. With any luck they'll cough up now you've taken it down.

Thanks. Thank goodness for contracts. While mine unfortunately didn't cover everything, it covered a lot of it. Enough that I at least have some recourse. Taking the site down, while not as satisfying as getting paid, will be some solace.

They'll look at the 2/3 they've already paid and realise it'll be easier for them to pay the remaining 1/3 and get the work than write off what they've already paid and have nothing to show for it.

You would hope so lol. Not everyone has common sense though. I am guessing their first move would have been to hire someone to try to steal the existing work. Which is why I wanted the theme files and graphics off the server.
