Domain Name Ownership Issue

Ok, I know the most obvious answer, but feel it's a little more complicated than that.

A friend/client of mine owns a Tree Surgery company and had somebody working alongside him, as a partner BUT not officially a legal partner in the sense it wasn't a financial pertnership.

Now this 'ex partner' registered a domain name (the whois shows he registered this in his own personal name details) and used some free website builder to create a website. Since then, the friendship/partnership has gone sour (for reasons unbeknown to the business owner) and this guy has deleted the site and refuses to give up the domain.

Now I know the obvious answer, seeing as the domain is in his personal details, is that it's tough, nothing can be done and just hope he doesn't renew on expiry, BUT this domain was registered/purchased using a company credit card so, surely, therefor is the property of the business, yes?

The domain is barcombeforestry.co.uk and the registrar details are:

Have tried contacting these guys but, to be honest, they simply weren't interested.

I would say if the company paid for it regardless of whos name is there and there is evidence of it, then its owned by the company!

1. Letter asking to transfer the property (i.e domain name) back to the business within 14 working days (send recorded)

2. 14 days up offer 7 days notice again of the above or threaten CCJ

3. If needs be pay £30 online and do a CCJ against him

Messy but no friends in business
