Right, I have a problem.

My friend runs this company (site nothing to do with me!). Initially it was his company but he took on somebody and it was run kind of like a partnership.

Now, this partner has decided to just up and leave, for reasons unknown and is being awkward regarding the website/domain name/emails. Until the partnership, this company did not have an online presence and the domain name has been registered in the name of the partner that has gone awol!

Needles to say, the actual company owner is keen to gain control of this domain/website before anything happens to it!

The domain was registered with these guys but it would appear it is being hosted elsewhere, but where I don't know!

What are my options here guys? Does the domain belong to the company? Can I/we retrieve it?

Why do people not draw up contracts? sigh.

If it's registered in his personal name then it's his. Best bet is to contact the registrar and try to explain and keep fingers crossed!

The person who the domain is registered to doesn't own the company.

Unfortunately he does own the domain name though.

This is why we have domain squatters out there. It's not who owns the company it's who owns the domain.

Would it make a difference if it was purchased using a company bank account/credit card?

But he owns the domain. Unless that domain name is using a 'tradmark' such as 'myebayshop.com' then eBay can take this domain - at cost.

File a complaint with the host and domain controller and plea your case to them. Quoting any business numbers etc and proof you own the business.

Edit: You may be able to file a 'lost account details plea ;) using your credit card as proof to pretend to be the nasty ex partner? - If you get what I mean?

It's not my business, but yeah I get what you mean. Just wondered if there was any "nice" ways of doing it before I adopt the persona of aforementioned nasty partner lol.

LOL

On the upside, the potential client wants a new site, so all's good :)
