Mailing lists and data protection Can I store information in the US?

A client of mine wants to set up a substantial mailing list and is looking into options. At the moment they're using a rather crude method, sending out from their mail server in batches of 100 so that it doesn't all get clogged up. My main concern is that they'll get blacklisted because they're regularly sending out to 5-6,000 recipients, so I'm currently advising them to use a more professional system instead.

We've found Vertical Response, which looks like a good system (and I've heard it recommended elsewhere too), but it's based in the US. I've heard rumours that there are legal issues surrounding storing people's contact details in another country, but I'm not sure where to look to find out more precise information about it. My understanding is that if the service provider is physically based in the US it has to abide by US laws, not UK laws, which makes sense. So how legal is it for us (based in the UK) to store contact details of our recipients (also based in the UK) in the US?

If anyone can point me in the right direction I would be very grateful - this isn't something my client can really afford to get wrong!!

May or may not help, but alot of the large companies store our data abroad.

As far as i am aware, (so not proper legal advice) just need to inform everyone that theyre details are being held in a secure server in the US, and if they want more information about how you handle the information, then you need to answer any questions they may have to an extent "what colour screws are used on the server" is abit far.


However, i am sure you can find some documents online about this?
