Another copyright question

Just out of curiosity. I'm designing a site for a client, and they have sent me some booklets / flyers that have been designed for their business before which I think would be a good starting point for the website design to keep in theme with it.. the colour scheme, and one of the illustrations, the font, (and the logo of course).

If you design the website based on the flyer, do you have to get permission from the previous designer to translate their ideas to the web, or does the copyright of design / images remain with the client to use for future publications etc?

ive lost count of the times i've called my client's printers to get the original source files!

You have to remember if the company is established and has an established brand then all you are doing when using the same colours on the leaflets is sticking to their brand identity.

Images on the other hand are trickier as if they are stock images, they might of just been bought to use on that one item, as a lot of royalty free stock images have a one time usage to them, so use them on a leaflet that is fine, want to use it on a website you will need to buy it again.

So best bet is to ask a the original designers about the design, while explaining you have been asked to create a website in keeping with the companies existing brand and marketing material. Normally designers are helpful :)

Yeah I've emailed them something along the lines of that. There is an image that looks very much like a stock image but I may be wrong, so that's a good point, thanks :)
